These Terms & Conditions apply to all quotations, product sales, orders, deliveries, collections, and installation services supplied by Enerlux (Pty) Ltd. By accepting a quotation, placing an order, paying a deposit, making payment, arranging collection, accepting delivery, or allowing installation work to proceed, the customer agrees to these Terms & Conditions.
2) Payment Policy
Accepted payment methods: Enerlux accepts Electronic Funds Transfer (EFT) and approved online payment gateway payments only, unless otherwise agreed to in writing.
Order processing: Orders may be processed once proof of payment is received, but dispatch, delivery, or collection will only take place after funds have cleared in the Enerlux bank account.
Full payment for goods: The full invoice value must reflect in our account before goods are released, dispatched, collected, or handed over to a courier.
Installation deposits: For installation projects, deposits and payment milestones will be agreed to in the accepted quotation or project agreement.
No walk-in payments: The warehouse does not accept physical payments. All warehouse visits are strictly by appointment only.
3) Pricing, Quotes & Availability
Quotation validity: Unless stated otherwise, quotations are valid for 7 calendar days and remain subject to stock availability, supplier pricing, exchange-rate changes, and specification updates.
Errors and omissions: Enerlux reserves the right to correct obvious pricing, stock, specification, or typographical errors. The customer may then proceed under the corrected terms or cancel for a refund where applicable.
Stock availability: Stock is not reserved until payment has been received and confirmed by Enerlux.
Product substitutions: Where an item is discontinued, unavailable, or out of stock, Enerlux may offer an equivalent or better-specified alternative, subject to customer approval.
4) Orders, Dispatch & Shipping
All goods are dispatched, shipped, or collected on behalf of and at the instruction of the customer. Once goods have left the premises, warehouse, supplier facility, courier depot, or collection point arranged by Enerlux, the customer accepts responsibility for the order during transport.
Dispatch timing: Orders are dispatched only after cleared funds have been received and stock has been allocated.
Couriers: Goods are shipped using third-party courier services. Risk in the goods passes to the customer once the goods are collected by the courier, collected by the customer, or released to the customer’s appointed transport company.
Shipping insurance: Shipments are uninsured by default unless otherwise agreed to in writing. Transit insurance can be arranged on request and will be charged separately.
Transit liability: Enerlux shall not be held liable for any loss, theft, hijacking, looting, fire, water damage, negligence, mishandling, accidental damage, delays, force majeure events, or damages incurred during transportation or transit after the goods have been released.
Packaging fees: Additional packaging, crating, palletising, or protective packaging charges may apply for fragile, oversized, or high-value items, including but not limited to solar panels, batteries, generators, inverters, and electrical equipment.
Estimated delivery times: Delivery timeframes are estimates only and are subject to stock availability, supplier dispatch schedules, courier operations, weather conditions, regional accessibility, and other logistical factors. Standard delivery is typically 2–10 working days within South Africa.
National shipping: Enerlux currently provides national shipping within South Africa only, unless otherwise agreed to in writing.
Customer delivery details: The customer is responsible for providing the correct delivery address, contact details, and delivery instructions.
Receiving goods: The customer or receiving party must be available to receive and inspect the goods upon delivery.
Customer-arranged couriers: Customers may arrange their own courier or transport company, provided Enerlux is notified in advance and collection takes place within the agreed collection times.
Transit damage or shortages: Any shortages, visible damage, or delivery discrepancies must be reported to Enerlux within 24 hours of delivery, together with supporting photographs and documentation.
Signed deliveries: Enerlux reserves the right to refuse liability for transit-related damages or shortages where goods were signed for as received in good condition.
5) Collection & Site Visits
Enerlux does not operate a walk-in retail shop.
Warehouse access is by scheduled appointment only.
Collections may take place from 3 Rydal Ln, Longlake, Sandton, or another confirmed supplier, warehouse, or dispatch point arranged by Enerlux.
Customers or appointed couriers must collect within the agreed collection timeframes.
No goods will be released without confirmed payment and the required collection documentation, where applicable.
6) Cancellations
Within 48 hours: Orders cancelled within 48 hours of order placement may be cancelled without penalty, provided the order has not yet been dispatched, collected, specially ordered, or prepared for installation.
After 48 hours but before dispatch: A 5% administrative or processing fee may apply.
After dispatch or collection: The cancellation will be treated as a return and will be subject to the Returns & Refunds section below.
Non-refundable costs: Courier fees, packaging fees, special handling charges, and other third-party costs are non-refundable.
7) Returns & Refunds
Return window: Customers may request a return within 7 days of purchase or receipt, subject to the conditions below.
Unopened and sealed products: A full refund of the product price may be processed where the product is unused, unopened, in its original packaging, complete with all accessories, and accompanied by the original tax invoice.
Opened or unsealed products: Opened or unsealed products may attract a 10% handling fee, provided the goods are complete, unused, not installed, undamaged, and returned in their original packaging.
Excluded items: Custom-made items, special-order products, cut cabling, bespoke mountings, switchgear, installed items, damaged items, scratched items, tampered products, or used goods are not eligible for standard return unless otherwise approved by Enerlux.
Return authorisation: Customers must request return authorisation before returning any goods.
Return transport: Return courier costs are for the customer’s account unless otherwise agreed to in writing.
Inspection: Refunds are subject to inspection and approval by Enerlux, the supplier, manufacturer, or distributor where applicable.
Refund method: Approved refunds are processed to the original payer or verified bank account after inspection and approval.
8) Warranty & Out-of-Box Failure
Manufacturer warranties: Product warranties are provided by the relevant manufacturer, supplier, or distributor. Warranty periods and conditions vary by brand and product type.
Installation requirement: Products must be installed by a suitably qualified or accredited installer and must comply with manufacturer specifications, wiring requirements, safety requirements, and local regulations.
Warranty exclusions: Warranty claims may be rejected for non-compliant installation, incorrect wiring, missing surge protection, incorrect breakers or fuses, tampering, physical damage, liquid ingress, infestation, misuse, abuse, or operation outside product specifications.
Surge and protection requirements: Where required by the manufacturer or installation standard, correct AC and DC surge protection, breakers, isolators, fuses, and protective devices must be installed.
Out-of-box failure: Items that have been installed, used, opened, or tampered with may not qualify for immediate out-of-box replacement and may need to follow the manufacturer’s warranty assessment process.
Serial numbers: Product and packaging serial numbers must match Enerlux, supplier, or manufacturer records.
Proof of purchase: The original invoice is required for all warranty claims.
Warranty process: Suspected faults must be logged with Enerlux and may require fault details, installer reports, photographs, serial numbers, and completed warranty forms before assessment.
9) Installation Services
This section applies where Enerlux is contracted to provide installation services.
Site assessment: A site assessment may be required to confirm roof suitability, electrical layout, DB location, cable routes, system design, access requirements, and installation feasibility.
Scope of work: Installation work is limited to the accepted quotation. Any additional electrical work, DB upgrades, rewiring, roofing repairs, trenching, structural work, or unquoted work will be quoted separately if required.
Permits and approvals: Where applicable, Enerlux may assist with SSEG applications, municipal requirements, or utility approvals. Approval timelines remain outside Enerlux’s control.
Workmanship standards: Installations are completed according to industry best practices, safety requirements, and applicable local standards.
Commissioning and handover: On completion, Enerlux will test and commission the installed system and provide relevant documentation where applicable.
Certificate of Compliance: A CoC may be provided for the specific electrical work completed by Enerlux where included in the quotation. A full-property CoC is not included unless expressly quoted.
Monitoring setup: Where supported by the system and included in the scope, Enerlux may assist with monitoring setup. Ongoing monitoring, maintenance, or support may be chargeable.
Third-party installers: Where the customer appoints their own installer, Enerlux is not liable for workmanship, installation faults, product damage, non-compliance, or system performance issues caused by the third-party installer.
Right to refuse or stop work: Enerlux may defer, stop, or refuse work where the site is unsafe, non-compliant, inaccessible, structurally unsuitable, or where customer-requested changes may create safety, warranty, or compliance risks.
10) Customer Responsibilities
The customer must provide accurate site, electrical, delivery, and contact information.
The customer must ensure suitable access to the property, DB board, roof area, inverter location, and installation areas.
The customer must ensure that roof structures, walls, mounting areas, and supporting structures are suitable for the installation.
The customer must maintain safe working conditions and avoid interfering with installers during electrical work.
The customer must operate and maintain all equipment according to manufacturer’s instructions.
The customer must report any faults, alarms, abnormal behaviour, or system issues as soon as reasonably possible.
11) Limitation of Liability
To the maximum extent permitted by South African law, Enerlux shall not be liable for indirect, consequential, special, or incidental damages, including loss of profit, loss of production, loss of use, business interruption, or loss caused by third-party actions.
Electrical and environmental events: Enerlux is not liable for damage caused by lightning, surges, grid instability, wiring faults, water ingress, fire, storms, flooding, acts of nature, or other external events outside our control.
Third-party acts: Enerlux is not liable for courier damage, courier loss, delays by authorities, utility delays, third-party installer errors, or customer-appointed contractor faults.
Misuse or non-compliance: Enerlux is not liable for product failure or damage caused by misuse, abuse, incorrect installation, lack of maintenance, unauthorised changes, or non-compliant electrical work.
Liability limit: Where liability cannot legally be excluded, Enerlux’s liability is limited to the amount paid for the specific goods or services giving rise to the claim.
12) Intellectual Property
All website content, text, images, logos, branding, product descriptions, documentation, and marketing material are owned by Enerlux or used under licence. No content may be copied, reproduced, modified, distributed, or used without written permission from Enerlux.
13) Privacy & Cookies
Enerlux processes personal information in accordance with applicable South African privacy laws and our Privacy Policy and Cookie Policy, available on our website. By using our website, requesting a quotation, placing an order, or using our services, the customer acknowledges the collection and processing of relevant personal information for business, sales, delivery, warranty, and support purposes.
14) Force Majeure
Enerlux shall not be responsible for delays, failure to perform, delivery interruptions, installation delays, or stock delays caused by events beyond our reasonable control. These events may include, but are not limited to, acts of God, strikes, war, pandemics, civil unrest, power outages, supply-chain disruptions, courier delays, supplier delays, weather events, or government restrictions.
15) Governing Law & Disputes
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be handled in South African courts with jurisdiction determined by the customer’s domicile or Enerlux’s principal place of business. Enerlux may offer to resolve disputes through good-faith discussions or mediation before litigation where appropriate.
16) Changes to These Terms
Enerlux may update these Terms & Conditions from time to time. Updated terms become effective when published on the Enerlux website with the revised effective date.
